Copyright and DMCA Policy

Launch Status

This page is a counsel-ready draft. Private Library, Vault Connector, and upload-to-access features remain launch-gated until the Designated Agent registration, public contact information, counter-notice process, repeat-infringer workflow, and operational audit trail are complete.

Copyright Program

ThePhilosopher.AI maintains a copyright compliance program for user-uploaded content. Uploaded private-library content is isolated per user, is not shared with other users, and is disabled from retrieval and AI processing when a compliant copyright notice identifies the content pending review, counter-notice, claimant withdrawal, or legal resolution.

Designated Agent

The following Designated Agent information must be populated after registration with the U.S. Copyright Office and before enabling the covered features outside internal testing:

  • Name: [Designated Agent Name]
  • Organization: ThePhilosopher.AI
  • Email: [copyright notice email]
  • Mailing address: [registered mailing address]
  • Phone: [agent phone, if used]

Submitting a Copyright Notice

A copyright notice should include:

  • Your physical or electronic signature.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it.
  • Your contact information, including name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the copyright owner.

Counter-Notices

If your content is disabled because of a copyright notice, you may submit a counter-notice if you believe the material was removed or disabled by mistake or misidentification. A counter-notice should include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the appropriate U.S. federal district court and will accept service of process from the claimant or the claimant's agent.

Repeat Infringer Policy

ThePhilosopher.AI uses a three-strike baseline for repeat copyright infringement: three valid, non-withdrawn, unrebutted copyright strikes within a rolling 12-month period may result in account termination. We may terminate earlier if required by law, if infringement is knowing or egregious, or if an account attempts to evade takedown or access controls. Notices withdrawn by the claimant, rejected after review, or defeated by successful counter-notice are not counted as strikes.

Misrepresentations

Copyright notices and counter-notices should be accurate and submitted in good faith. Knowingly materially misrepresenting that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may create legal liability.
